Do You Need a Site Plan for a Pergola Permit?

Yes, nearly everywhere a pergola needs a permit, the application includes a site plan, and in many cities the site plan matters even where the building permit does not. A pergola is the rare project that is mostly air, so people assume the paperwork is lighter. The review runs the other way: with no walls or interior to examine, almost everything a reviewer checks about a pergola is on the site plan.

A pergola is mostly air, but the review is about the ground

A building reviewer looking at a shed checks walls, a roof, and a floor. Looking at a pergola, they check two things: where the posts meet the ground, and how much ground the structure covers. Both live on the site plan.

That is why the drawing for an open structure is not simpler than the drawing for a closed one. The posts are located and dimensioned because footings are the inspection a pergola actually gets. The roof outline is drawn, usually as a dashed rectangle spanning the posts, because the covered area is what the size thresholds count, and because setbacks are generally measured to the edge of the projection rather than to the post. A pergola whose posts sit a tidy 5 feet inside the line can still encroach with an 18-inch overhang.

When a pergola permit needs a site plan, by the numbers

For a freestanding pergola, the exemption line runs from nothing at all in Fort Worth and Evansville, where every accessory structure needs a permit, through 100 square feet in Cincinnati, 120 in Houston, Indianapolis, and South Bend, 169 in Columbus, 200 in Austin, Dallas, Toledo, and most of Massachusetts, to 300 in San Antonio, and even that depends on the department reading a shade structure as a shed-like use. North Carolina ignores area and measures dimensions: over 12 feet in any direction, length, width, or height, and the code applies, which catches nearly every pergola long enough to shade a table.

Attached is a different story everywhere. Connect the pergola to the house and it stops being an accessory structure in almost every code, which is why the site plan makes the attachment, or the gap, unmistakable.

And the size thresholds are only the building side. Mecklenburg County requires a zoning permit for accessory structures at any size. Toledo issues a Certificate of Zoning Compliance below its permit line. Indianapolis adds a drainage permit to any accessory structure over 120 square feet. Each of those reviews reads the same document: your site plan.

What your pergola site plan has to show

The reviewer's checklist for an open structure is short and entirely measurable:

  • Property lines and lot dimensions, from your plat or county parcel records, not paced off.
  • The house and every existing structure, drawn to scale, because coverage math is cumulative.
  • The pergola's posts, located with dimensions, and the roof outline spanning them.
  • Setback distances from the roof edge to each property line, written in feet and inches.
  • The attachment or the gap to the house, labeled.
  • The surface underneath, patio, deck, or slab, shown as built.
  • Easements, because a footing inside a utility easement fails the review no matter what else is right.
  • North arrow, scale, and parcel number on the sheet.

The patio underneath is part of the drawing

Most pergolas go over something, and that something is usually the half of the project reviewers care about. Hard surface is impervious cover, and impervious cover is regulated arithmetic: Raleigh, for example, sends any project adding 800 square feet or more of impervious surface into lot-grading review under its stormwater manual. A pergola adds almost nothing to that math by itself, but the patio being poured under it in the same season adds all of it, and the two are reviewed as one project when they arrive on one site plan.

The reverse trap is older surfaces. Pennsylvania exempts an uncovered deck under 30 inches; put a pergola over it and the word uncovered no longer describes it, so the deck's own exemption disappears. South Bend writes the same idea in four words, requiring a permit for any porch or deck with a roof or trellis.
